If you are using our Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

By accessing or using BeyondAI's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services. We reserve the right to modify these terms at any time, and your continued use of our services constitutes acceptance of any changes.

BeyondAI provides AI-powered automation services for real estate professionals, including but not limited to lead follow-up, lead reactivation, CMA generation, listing descriptions, and content creation. Our services integrate with various CRM systems and communication platforms to deliver automated workflows designed to increase efficiency and conversion rates for real estate businesses.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEYONDAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR USE OR INABILITY TO USE OUR SERVICES; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; (C) ANY ERRORS, MISTAKES, OR INACCURACIES IN CONTENT OR AI-GENERATED OUTPUT; (D) ANY THIRD-PARTY CONTENT OR CONDUCT. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Intellectual Property Rights

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, images, software, and AI models, are owned by BeyondAI or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any content you provide to our Services. By using our Services, you grant us a limited, non-exclusive, royalty-free license to use, store, and process your content solely for the purpose of providing our Services to you.

Termination

You may cancel your subscription at any time through your account settings. Cancellation will be effective at the end of your current billing period, and you will continue to have access to the Services until that time.

We reserve the right to suspend or terminate your access to our Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

Upon termination, we will delete or anonymize your data in accordance with our Privacy Policy, except as required by law or for legitimate business purposes.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or our Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property infringement or violation of confidentiality obligations.

You waive any right to participate in a class action lawsuit or class-wide arbitration against BeyondAI.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through a prominent notice on our Services at least 30 days before the changes take effect.

Your continued use of our Services after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the modified Terms, you must stop using our Services and cancel your subscription.
